Ocean Net IT Terms of Trade and Conditions
1. Definitions Services:
VoIP, broadband, mobile, and any other telecommunications services we provide. Customer: The individual or business entity that applies for and uses the Services. Agreement: These Terms, including any additional terms for specific Services.
2. Acceptance of Services
We may accept or reject service applications at our discretion. Our services are offered on a best-efforts basis and may be affected by factors outside our control, such as power outages or internet disruptions. Emergency calling is not guaranteed. Compatibility with non-voice devices is not assured.
3. Charges and Payment Prepay basis;
billed monthly in advance. Hourly support is $180/hour. Positive credit balance is required. We accept credit/debit cards and online banking only. Services disconnect automatically if credit is depleted. We may introduce credit card fees with notice. Non-payment may result in suspension/termination without notice. Charges still apply. Rates may change with prior notice on our website. Disputes must be submitted in writing within 30 days. Inactive accounts (6+ months) will lose unused credit. Directors of company accounts are jointly liable. Late payments may incur 2.5% monthly interest. Collection costs apply. Reconnection fee: $20 per service.
4. Customer Responsibilities
Do not use services unlawfully or maliciously. Keep your account information accurate. Breach of terms may lead to termination. Excessive use may trigger additional charges or suspension. Keep credentials secure. Terminated services lose access to numbers and portals.
5. Phone Numbers Remain the property of Ocean Net IT.
May be changed with notice. Inactive accounts (3+ months) may lose numbers. Porting is possible at customer’s expense.
6. Broadband Services Subject to qualification.
Speeds are max values, may vary. No distribution of viruses or breaches of security. We are not responsible for internet content or malware. Technicians may require site access.
7. Termination and Suspension
We may immediately terminate services for breaches. To cancel, submit a support request to team@oceannet.co.nz and accounts@oceannet.co.nz. A 30-day notice applies. No refunds for unused credit.
8. Liability and Indemnity
We are not liable for service failures except in cases of gross negligence. Liability is limited to average monthly charges. Customers indemnify us from claims related to their use of services.
9. Privacy and Data Protection
We collect and store personal data to provide services. We may share information to prevent fraud or meet legal obligations. Calls may be recorded for quality and training. Privacy over internet/third-party networks is not guaranteed.
10. Changes to Terms Terms may be updated with notice via email or on our website.
11. Notices Email is the primary communication method. Notices to your email are considered received.
12. Governing Law These Terms follow New Zealand law. Disputes will be handled in NZ courts. You may not transfer your rights; we may transfer ours. Failure to enforce any part does not waive our rights. © 2025 Ocean Net Ltd. All rights reserved.
